Scalp Injury Compensation Claims

Introduction – what is the scalp?

Scalp consists of several distinct layers: hairy skin, the subcutaneous fat and connective tissue layer, the galea or aponeurosis (a thin fibrous layer to which the flat epicranial muscles are attached), a thin layer of connective tissue and finally, the periostium of the skull.

The scalp is susceptible to all types of injury, particularly laceration injuries as it is readily crushed and split against the underlying bone. Such lacerations are often linear due to the convexity of the underlying skull. The scalp often swells markedly due to oedema (waterlogged tissues) or haematoma formation (raised swelling) due to bruising above or below the galeal layer. Dense hair may mask scalp injuries.

Common Types of Compensation Claim

  1. Accidents at Work
    Scalp injuries occur all too frequently in the workplace, especially where machinery is involved or where toxic substances are used. In general where it can be shown that an employer has not taken sufficient care for the safety of the workforce then a claim for compensation can be made in the event of an accident taking place and the victim suffering decipherable injuries.
  2. Road Traffic Accidents
    Scalp injuries are often an associated injury when dealing with head trauma which is a common result in all types of road traffic claim.
  3. Claims Against Hairdressers
    Where a hairdresser or colourist has used unsuitable or dangerous chemical dyes or substances on the hair of a customer and the result has been an injury to the scalp then it may be possible to make a claim for compensation against the salon in question. Hairdressers should take extreme care when using chemical based products on their customers and should always ensure that the customer is not allergic or prone to react to each and every product used.

Scalp Injuries

  1. Damage to Hair
    Most usually occurs due to the consequences of defective perming, tinting or colouring. Hair can become brittle and in certain circumstances hair loss may occur both temporary and permanent. In more extreme cases the victim can suffer psychological disability as well.
  2. Burning to scalp
    Burning or irritation may occur to the scalp as a result of chemical usage or exposure to certain toxins. Damages will be awarded commensurate with the extent of any scarring and the associated hair loss and pain.
  3. Laceration Injuries
    Damages will be assessed depending on the nature and extent of the scarring that has been left as a result of the injury. If the scar is clearly visible within the hair or on the edge of the hairline then compensation awards will tend to be higher than if the scar is well covered.
