Child claims – Compensation advice

Children are always having accidents and injuring themselves. Occasionally however they sustain an injury through no fault of their own.

Out of the thousands of children’s claims that are brought about each year the majority of injuries occur either at home, in school or on the road. As in all compensation claims the amount of damages awarded will depend entirely on the circumstances of the case and the nature of the injuries sustained.

The law states that children under the age of 18 are not entitled to bring a claim for compensation as they are deemed to young. An adult therefore needs to be appointed to act in the child’s best interests. The adult is usually a family member and their function is to make decisions on behalf of the child and for their benefit in order to protect their interests. The adult representative is commonly known as the litigation friend.
