Back seat passenger claims – Compensation advice

It is the individual responsibility of all passengers to wear seatbelts whether or not they are in the back of the vehicle or not. This is the case except where a child is under 14 years of age when it is the driver’s responsibility. Furthermore, all children must wear the appropriate restraint for their age.

I f a passenger is injured in an accident it is possible to commence an action for damages for personal injury against either the driver of the vehicle in which the injured party was a passenger or the driver of the vehicle responsible (if different).

The issue relating to the usage of seatbelts is extremely relevant as it can have a bearing on the amount of compensation that is received as a result of a victim’s injuries. As a rule of thumb the courts tend to deduct 25% from any award of damages of compensation if the victim was found not to have been wearing a seatbelt.
