Accidents in shops – Compensation Claims

A high proportion of tripping and slipping accidents and subsequent injuries are sustained in retail premises. Shops however are obliged to provide a safe environment for their customers and as such may be liable under the occupiers liability Act and generally in the law of negligence if they breach their duties which are owed to the paying customer and or legal visitor. It is worth noting that retail stores are forever encouraging customers to look at their produce and as such it is upon them to ensure that the alley ways and the floor areas are clear and hazard free. There are three main types of accident claim, as follows:

Compensation claims for accidents and injuries caused by slippery floors

This is the most common type of accident claim. Claims range from cases where customers have slipped due to a wet or shiny floor to claims where dangerous substances have been left on floors creating a hazard. These claims often involve supermarkets, food stores and also department stores where floors can become over polished and are mostly slippery when wet.

Compensation claims for accidents and injuries caused obstructed walk ways

Most commonly claims such as these involve hidden steps, faulty stairs and or obstructing displays. These can cause a number of injuries.

Compensation claims for accidents and injuries caused by stock being left on the floor

This type of accident tends to happen mostly in supermarkets where food items can be dropped and or left remaining on the floor often by other customers. The shop is under a duty to ensure that the floors are kept clear. If they fail in this duty then a claim for compensation will often succeed.
