Skin Disease Claims


Occupational skin diseases often result from exposure to chemical irritants such as industrial solvents, industrial cleaners, industrial fluids generally and most chemicals used in industrial processes. The occupations at the highest risk are not all in heavy industry and it has been shown that hairdressers and barbers tend to come into contact with more mildly hazardous chemicals than any other profession. However, it is in the manufacture of industrial products such as chemicals, soaps and cleaners that the most high value claims are made.

Dermatitis Claims

The most common form is contact dermatitis. Symptomology varies between the type of dermatitis but most commonly it takes the form of a rash and the skin may become itchy and sore with occasional cracking and bleeding. It is not uncommon for this sort of condition to become more permanent and it will often have an effect on all aspects of the Claimant’s life.

A Claim can be made in relation to an occupational skin disease if it can be shown that the Claimant’s employer has not done all that was reasonable to protect them when dealing with potentially hazardous chemicals. Chemicals can range from metals, rubber, oils, cleaning agents and solvents many of which are used in a wide range of industry.

The law relating to industrial skin diseases is contained mostly with the Control of Substances Hazardous to Health Regulations 1994. As with all Regulations they oblige all employers to carry out the necessary risk assessment in relation to any substances which their employees may be exposed to in the course of their employment. They are then obliged to ensure that they have taken all reasonable steps to protect them.
