Public Transport Claims

Accidents on public transport – Compensation Claims

If as a passenger in a bus, taxi cab or train, you are injured through no fault of your own then it is quite possible that you may have grounds for a claim for damages for Personal Injury and Loss. The most important issue is whether the driver of the vehicle in which you were a passenger is fully insured. If he/she is then you can make a claim against his/her insurers OR it is possible to make a claim against the diver responsible for the accident as well. Issues relating to the wearing of seatbelts may well be relevant when dealing with compensation Claims under this heading and as such it is important to take advise from your Claims Solicitor.

In general accidents on public transport fall in to three categories

Compensation claims for accidents and injuries caused when a passenger on a bus

It is extremely common for passengers on public buses to suffer injuries as a result of other drivers or the actions of the bus drive. It is important to note that when making a claim a Claimant should present the Claim Solicitor with as much information as possible in relation to the number of the bus, the bus company, the driver and if possible details of the third party. The most common injuries sustained on buses are whiplash type injuries often due to the bus making a sudden stop or manoeuvre. It is also common for passengers who are standing to be injured when the bus makes a sudden or violent manoeuvre. It is important that if you are injured you seek advice from your doctor as soon as possible before instructing a solicitor.

Compensation claims for accidents and injuries caused when a passenger in a taxi cab

Whether the taxi is a hackney cab or a mini cab it is important to be aware that if an accident occurs through no fault of your own then you are in a position to make a claim for damages if you are injured as a result. As with all road traffic accidents it is important to establish whether or not you as the victim were wearing your seatbelt. It is recommended that seatbelts are worn at all times and as such any damages will be reduced if it is found that a seatbelt was not worn. It is important if you are involved in an accident when in a taxi cab that you take down all of the details including the name and address of the driver and the registration of the vehicle. It is also essential that you take down the details of the other driver involved if appropriate.

Compensation claims for accidents and injuries caused when a passenger on a train

Accidents causing passenger injury are not uncommon on trains and are usually due to sudden breaking manoeuvres by the driver. In general terms the train operator will be responsible for the actions of the driver and as such if you are injured as a result of the actions of a train drive then it is important to note as many details as possible relating to the actual train itself and where possible the drive. Accidents involving trains can of course have catastrophic consequences and as such it is important that you or your relatives seek advice from a specialist Claim Solicitor at the earliest opportunity.

If you or anybody you know has had an accident on a train and sustained injury as a result in the last three years then it may be possible to make a claim for compensation for these injuries. This would of course depend on the facts and as such we recommend that you contact us via the Claim Assessment Form so that one of our qualified solicitors can confirm that you have a valid case for compensation and therefore assess your claim.

Please note that all of our solicitors act on a no win, no fee basis and that you will receive 100% of any damages that may be awarded.
