Poisonous Substance ClaimsWhat is a Poisonous Substance Claim? It is common for employees within workplaces to be exposed to numerous poisonous substances in the course of their employment. It is however the duty of any employer to ensure, as far as possible, that his employees are protected against any harmful effects that may arise out of any contact with any toxic or poisonous substance. Poisonous Substance Claims Accidents at work claims – lack of suitable protective clothing It is the duty of any employer to ensure that his workforce are provided with the correct and safe protective equipment including clothing when they are caused in the course of their employment to deal with dangerous and/or poisonous substances. The type of protective clothing will usually involve face masks, gloves and specialist clothing which nullifies the corrosive effects of a number of commonly used chemicals. If an employer fails in this duty and an employee is injured then that employee will have the right to make a claim for compensation against his/her employer. Accidents at work claims – lack of training All employers are obliged to provide adequate training to their employees. This is especially true where the employees are caused to work with dangerous and poisonous substances. The training will always need to focus primarily on the safety of the employee and other employees working with him/her. Therefore, if an incident occurs which is due to the employee’s lack of knowledge or training then it is quite possible that the employer will be liable for he may not have discharged his duty of care. If injuries are sustained then a claim for compensation can be made. Accidents at work claims – defective safety equipment Where an industry uses poisonous and dangerous substances the focus is generally upon the safety of employees and visitors to the plant. However, where safety equipment has not been properly maintained or is defective then this is more than likely to cause an incidence which may lead to a member of staff being injured.
