What is a Pedestrian Injury Claim?

A claim for accident compensation can be made if a victim has been injured whilst a pedestrian on any road, highway or pavement. If you have been injured within the last 3 years then you may be entitled to make a claim for compensation against the person responsible.

Types of Pedestrian Injury Claim

Accident claims involving motor vehicles

Pedestrians have the right of way in all circumstances and situations. Therefore, if you have been struck or knocked down by any motor vehicle it may be possible to make a compensation claim against the driver of the vehicle in question.

Accident claims involving bicycles

If as a pedestrian you have been knocked down by a bicycle either on the pavement or on the road then you may have a claim for compensation against the rider in question.

Accident claims involving trips, slips and falls

Claims for compensation can be made when a pedestrian falls and injures his/herself as a result of dangerous and hazardous roads and pavements which are the responsibility of the local authority to maintain. They have a duty to ensure that the highways are safe.

Types of Injury

1. Fractured foot compensation claims
More usually known as a broken foot. These range from serious displaced fractures requiring surgical intervention to less serious hairline breaks. Generally these are treated with a plaster cast and back slab. Recovery can take between six to twelve weeks and it is possible that the individual may be left with some residual disability.

2. Sprained foot compensation claims
Commonly known as soft tissue or ligament injuries. As with all injuries the symptoms vary from person to person and damages will be assessed individually depending on any residual symptoms that may exist.

3. Fractured knee compensation claims

6. Sprained leg compensation claims
Commonly known as soft tissue or ligament injuries. As with all injuries the symptoms vary from person to person and damages will be assessed individually depending on any residual symptoms that may exist.

The only way to prove that an area is dangerous and therefore a tripping hazard, is by photographic evidence. It is essential that the exact location and the exact defect is identified and it is always a question of fact as to whether or not an area was dangerous or not. The Law applies common sense rules in cases such as this. As with all claims, it is preferable if witnesses are available to give evidence. It is also beneficial to a claims success if the accident was reported to the relevant local authority, shop-keeper or owner of the premises.
