Dental Claims
A Dentist will be seen to have acted negligently if they have provided a patient with any treatment which falls below the minimum standard of care and skill which a reasonably qualified dentist would consider is acceptable in all of these circumstances. The test is that of the ‘competent dentist’. Negligence can occur by act or failure to act. Compensation Claims In order to commence their claim for damages for injuries sustained as a result of a dentist’s negligence, a victim must be able to show the following:- 1. The dentist’s negligence Has the dentist done or failed to do something which means that he/she has failed to provide you with the proper care. This can occur in all types of dentistry such as: - Peridontics 2. Has the negligence caused the patient personal injury? Only where a specific injury has resulted directly from the negligent act or omission can a claim for compensation succeed. This is always a question of fact and causation.
