Clinical Claims
Often known as Medical Negligence Claims, this type of accident claim will arise where a victim has received less that adequate treatment from a hospital, a doctor or any other professional or clinically trained person. The main issues are as follows:-
Liability Issues
- Was the care of a standard below that which is required? Was the treatment given that most reasonable doctors would endorse or in fact do themselves?
- Did this poor level of care actually cause of contribute to the injury and/or illnesses complained of.
Compensation
- What is the extent of the injury? What are the physical and psychological consequences over and above any resulting from the illness actually being treated?
- Are there any financial consequences for the Claimant such as lost earnings, future care or disability on the open labour market.
